1 Introduction

Welcome to Kochez Auto Spares ("we", "us", "our"). These Terms & Conditions ("Terms") govern your access to and use of our website, mobile application, marketplace, and any related products or services (collectively, the "Platform").

By accessing or using the Platform, registering an account, placing an order, or otherwise engaging with us, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Platform.

2 Definitions

• "Customer" means any person or entity that registers on or uses the Platform to purchase products or services.
• "Vendor" means any third party authorised to sell products through our marketplace.
• "Products" means auto spares, accessories, batteries, filters, lubricants, and other vehicle essentials offered through the Platform.
• "Services" means auto spares sourcing, fitment guidance, bulk supply, delivery support, and related customer services.
• "Order" means a request submitted by a Customer to purchase Products or Services.
• "Content" means text, images, videos, data, or any other material uploaded to or displayed on the Platform.

3 Eligibility

To use the Platform you must:

• Be at least 18 years of age, or the age of majority in your jurisdiction;
• Have the legal capacity to enter into binding contracts;
• Not be barred from using the Platform under the laws of Kenya or any other applicable jurisdiction;
• Provide accurate, current, and complete information during registration and checkout.

4 Your Account

Registration may be required to access certain features. You are responsible for:

• Maintaining the confidentiality of your login credentials;
• All activities that occur under your account;
• Notifying us immediately of any unauthorised use;
• Ensuring your account details remain accurate and up to date.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or unlawful activity.

5 Our Services

Kochez Auto Spares provides auto spares and vehicle accessory services, including but not limited to:

• Auto spare parts, accessories, and vehicle essentials;
• Web and mobile application development;
• UI/UX design and digital product strategy;
• Software consulting and systems integration;
• Maintenance, support, and technical advisory;
• An online store dedicated to quality auto spares, accessories, batteries, filters, and vehicle essentials.

Service descriptions, pricing and availability are subject to change without notice. We make reasonable efforts to keep information accurate but do not warrant that all details are error-free.

6 Orders & Payments

Order Acceptance

All Orders are subject to acceptance and availability. We reserve the right to refuse or cancel any Order at our discretion, including for pricing errors, suspected fraud, or stock unavailability.

Pricing

Prices are quoted in Kenyan Shillings (KES) unless otherwise stated and include applicable taxes where indicated. Delivery charges, if any, are shown at checkout.

Payment Methods

We accept the following payment methods:

• M-Pesa
• Visa and Mastercard
• Bank transfer (for approved accounts)
• Cash on delivery (selected locations)

Payment must be received in full before dispatch unless credit terms have been agreed in writing.

7 Delivery & Risk

Delivery timelines are estimates only and may vary due to weather, logistics, or other factors beyond our control. Risk of loss or damage passes to you upon delivery, and title passes upon receipt of full payment.

Please inspect goods on delivery and report any damage or shortage within 48 hours by contacting us at info@cybermaisha.co.ke.

8 Returns & Refunds

Returns are accepted within 7 days of delivery for eligible products, provided they are unused, in original packaging, and accompanied by proof of purchase.

The following are not eligible for return:

• Opened electrical parts, fitted parts, and special-order items once delivered;
• Devices with removed serial labels, damaged seals, or unauthorised modifications;
• Custom-ordered or special-order items;
• Items damaged due to misuse or improper storage.

Approved refunds are processed to the original payment method within 7–14 business days.

9 Technology Products & Software

Product specifications, compatibility information, and manufacturer requirements are provided for general guidance. Manufacturers and manufacturers may change specifications, fitment notes, and support policies without notice.

Customers are responsible for confirming that a device or licence is suitable for their intended environment. Special-order deliverables, acceptance criteria, support periods, and intellectual property terms will be defined in the applicable proposal or service agreement.

10 Intellectual Property

All Content on the Platform — including text, graphics, logos, images, catalog content, and compilations — is owned by Kochez Auto Spares or its licensors and is protected by copyright, trademark and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works without our prior written consent, except as permitted for personal, non-commercial use.

11 User Content

By submitting reviews, comments, photos or other Content to the Platform, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, and display that Content for marketing and operational purposes.

You agree not to post Content that:

• Is unlawful, defamatory, obscene or misleading;
• Infringes the rights of any third party;
• Contains viruses, malware, or harmful code;
• Constitutes spam or unauthorised advertising.

12 Privacy

We collect and process personal data in accordance with the Kenya Data Protection Act, 2019. For details on what we collect, why, and how we protect it, please see our Privacy Policy.

13 Limitation of Liability

To the maximum extent permitted by law, Kochez Auto Spares shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or lost business opportunities — arising out of or in connection with your use of the Platform.

Our total aggregate liability for any claim shall not exceed the amount you paid to us for the specific product or service giving rise to the claim.

14 Indemnity

You agree to indemnify and hold harmless Kochez Auto Spares, its directors, employees, and agents from any claims, losses, damages, liabilities and expenses arising from your breach of these Terms or your misuse of the Platform.

15 Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have breached these Terms or applicable law. You may also close your account at any time by contacting us.

16 Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising shall be subject to the exclusive jurisdiction of the courts of Kenya, unless otherwise required by mandatory law.

17 Changes to Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
